These Terms of Service ("Terms") govern your use of the websites, patient communications, and related services provided by Octane Solution Group, LLC ("Octane," "we," "us," or "our"), including text (SMS/MMS) messaging sent on behalf of the healthcare practices and organizations that use our platform ("Practices"). By using our services or by agreeing to receive text messages, you agree to these Terms. If you do not agree, do not use the services and opt out of messaging as described below.
Octane sends text messages to patients and other individuals on behalf of Practices with which you have a relationship. Messages are transactional and informational and relate to your care or account. Message types include:
We do not send marketing or promotional text messages, and we do not use text messaging for third-party advertising.
You opt in to receive text messages by (a) providing your mobile number to a Practice or to us and agreeing, on a patient intake form, registration form, web form, or verbally or in writing at the front desk, to be contacted by text message about your care and appointments; or (b) texting us first. Consent to receive text messages is not a condition of receiving care or of purchasing any good or service. When we or a Practice ask for your consent, the following (or substantially similar) language is presented:

Message frequency varies. Message and data rates may apply. Reply STOP to opt out or HELP for help. Consent is not a condition of care. Message frequency varies based on your appointments, prescriptions, and account activity. You will typically receive only a small number of messages per appointment or event.
Message and data rates may apply, according to your mobile carrier plan. Octane does not charge you for text messages. Carriers are not liable for delayed or undelivered messages.
You can cancel text messages at any time. Reply STOP to any message (the words STOPALL, UNSUBSCRIBE, CANCEL, END, and QUIT also work). You will receive one confirmation message and no further text messages from that number. You may also contact us at 562.653.4005 or info@octanesolutiongroup.com, or tell your Practice, and we will remove your number. Opting out of text messages does not cancel your care, and the Practice may continue to contact you by other methods such as phone, mail, or email.
If you opt out, you may stop receiving appointment reminders by text and may be unable to receive security codes by text. Where available, you may choose another delivery method.

Reply START (or UNSTOP) to a number you previously opted out of, or provide consent again through your Practice.
Text messaging is available on most major U.S. carriers. Availability is not guaranteed. You are responsible for keeping your mobile number current; notify your Practice or us if you change or give up your number so that messages are not delivered to someone else. Do not reply to a text message with sensitive health information such as diagnoses or medication details; text messages are not a secure channel, and you should call your Practice for clinical questions. Text messages are not for emergencies. If you are experiencing a medical emergency, call 911.
We do not sell, rent, or share your mobile phone number or text message opt-in data and consent with third parties or affiliates for their marketing or promotional purposes. Mobile information is shared only with the service providers (such as our messaging carriers and aggregators) needed to deliver the messages, and with the Practice that you are a patient of. See our Privacy Policy.
You may use the services only for lawful purposes and in accordance with these Terms. You agree not to: (a) access any account, patient record, or data you are not authorized to access; (b) attempt to disrupt, probe, or circumvent the security of the services; (c) use the services to send unlawful, harassing, deceptive, or unsolicited messages; or (d) reverse engineer or copy any part of the platform except as permitted by law.
Authorized users of Practices are responsible for safeguarding their credentials, for all activity under their accounts, and for promptly reporting suspected unauthorized access to info@octanesolutiongroup.com. We may require additional verification, including two-factor authentication, and may suspend access to protect patient information.
Each Practice is responsible for obtaining and documenting the consent of its patients to receive text messages, for the content of messages it directs us to send, and for complying with the Telephone Consumer Protection Act (TCPA), HIPAA, CTIA guidelines, carrier requirements, and other applicable law. We may suspend messaging for a Practice, or to a number, that does not comply.
Octane handles protected health information on behalf of Practices as a business associate, under a business associate agreement and in accordance with HIPAA. Text messages are designed to contain the minimum necessary information. Your use of the services does not create a provider-patient relationship with Octane; Octane does not provide medical advice.
The platform, websites, software, and content are owned by Octane or its licensors and are protected by law. We grant you a limited, non-exclusive, non-transferable, revocable right to use the services for their intended purpose. All rights not expressly granted are reserved.
The services rely on third parties, including telecommunications carriers and our messaging provider, Twilio Inc. Their services are subject to their own terms and policies, and we are not responsible for their acts or omissions, including carrier delays or filtering.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT MESSAGES WILL BE DELIVERED, TIMELY, OR ERROR-FREE.
TO THE FULLEST EXTENT PERMITTED BY LAW, OCTANE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICES, INCLUDING MISSED OR DELAYED MESSAGES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100), EXCEPT WHERE LAW DOES NOT PERMIT THIS LIMITATION.
You agree to indemnify and hold Octane harmless from claims, losses, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms or applicable law.
We may suspend or end your access, or stop sending messages to a number, at any time if we believe these Terms or the law have been violated or to protect the services or patients. You may stop receiving text messages at any time as described in section 1.5.
We may update these Terms from time to time. The "Last updated" date above shows the latest version. Material changes to the SMS program will be posted here before they take effect. Continued use of the services or continued receipt of messages after an update means you accept the revised Terms.
These Terms, together with our Privacy Policy, are the entire agreement between you and Octane regarding the services. If a provision is found unenforceable, the remainder stays in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent.
